Definitions

Article: An original written work submitted by its author for publication on WhozNews

Author: The creator of an original written work submitted for publication on WhozNews

Get: A vote for a posted article that shows the approval of a registered member of the site.

Site User: Any individual who visits WhozNews and/or uses any of WhozNews' features and Services, whether or not that individual has a membership account

Content: Written works, illustrations, videos, messages, postings, and any other written, visual, and/or audio submission to WhozNews, whether or not it is posted

Publisher: Any individual, webmaster, organization, corporation, or business entity that reprints, be it online or in print, an article written and published by a WhozNews user.

Site features and services

WhozNews provides Site Users with a variety of services, content, and features.

WhozNews, at any time and in our sole discretion, may add to, change, temporarily suspend, or discontinue one or more of these services with or without notice to Site Users and/or the public at large.

Additionally, WhozNews reserves the right to limit and/or restrict User access to one or more of these Services, in whole or in part, in our sole discretion, with or without notice to the affected User.

These Terms of Use apply to any and all Services currently offered by WhozNews and/or any and all Services WhozNews offers in the future.

Ads

You acknowledge that WhozNews is ad-supported. WhozNews reserves to the right place ads on the same pages as your article(s)

User conduct

You agree not to use any feature, service, or function of this Site for any purpose that is unlawful, prohibited by the Terms of Use, or any purpose that is not reasonably intended by WhozNews.

Unlawful and prohibited uses include, but are not limited to, the following:

  1. Inappropriate and/or abusive treatment or interaction with other WhozNews users, including but not limited to:

    a. Harassment

    b. Threats

    c. Impersonation

    d. Intimidation

  2. Posting, transmitting, and/or causing to be posted or transmitted Content that is:

    a. Infringing

    b. Libelous

    c. Defamatory

    d. Obscene

    e. Abusive

    f. Offensive

    g. Otherwise prohibited by any law or any right of any third party

  3. Creating or submitting Spam to any WhozNews user or any URL or website accessed through or obtained through the WhozNews site.
  4. Submitting stories or comments that link to:

    a. Affiliate programs

    b. Multi-level marketing schemes

    c. Sites, blogs, message boards, and/or newsgroups repurposing existing stories

    d. Off-topic content

  5. Artificially or fraudulently inflating or altering the ''Gets'' count of any Content posted on WhozNews, including but not limited to, such means as:

    a. Creating multiple user accounts

    b. Giving, receiving, or promising money or other remuneration in exchange for ''Gets'' and/or for creating multiple user accounts

    c. Participating in a scheme or organized effort to artificially alter or manipulate the Gets count of any Content, whether or not such scheme or effort is successful

  6. Advertising or soliciting any WhozNews User to buy or sell any products or services
  7. Selling or otherwise transferring your profile

Prohibited content

WhozNews does not allow articles or content containing pornographic material. Additionally, WhozNews does not allow articles or content promoting or advocating violence or illegal activities. If you submit or post prohibited material, you will be immediately banned and your account will be deleted.

Removing Content

WhozNews may, in its sole discretion and for any reason, remove, in whole or in part, any Content, with or without notice to the User who posted the Content.

Direct affiliate links

WhozNews absolutely forbids articles containing direct affiliate links. Any Article containing a direct affiliate link will be automatically rejected.

International users

International Users agree to abide by local laws regarding content and online conduct.

Interference with proper functioning of Site

By consenting to these Terms, you agree not to:

  1. Interfere or attempt to interfere with the proper functioning of this Site or with any Services of this Site
  2. Use a robot, spider, scraper, or any other automated means of accessing this Site for any reason at any time
  3. Take any action that will place an unreasonable burden on our infrastructure.
  4. Bypass or attempt to bypass measures we may use to limit or restrict access to portions of the Site or the Site as a whole

User responsibility

WhozNews reserves the right to resolve disputes between WhozNews Site Users. However, you are ultimately and solely responsible for your interactions with other Site Users. WhozNews is not obligated to monitor and/or attempt to resolve disputes between Site Users.

Contacting and/or soliciting WhozNews users

You agree not to use any information obtained through this Site in order to contact, advertise to, solicit, or sell to any User without that User's explicit, written consent.

Intellectual property rights

By submitting an Article to WhozNews you declare that you are the sole owner and author of the article, and you further declare that you own all copyrights pertaining to the article.

Adherence to the Creative Commons Public Domain License

By uploading, submitting, or otherwise distributing Content for display or inclusion on the Site, you declare that you own all rights to Content and you agree that the Content will be subject to the Creative Commons Public Domain License. The Creative Commons Public Domain License can be viewed at: http://creativecommons.org/licenses/publicdomain/.

Site Users are strongly encouraged to review the content of the Creative Commons Public Domain License. WhozNews reserves the right to suspend, freeze, or delete the membership account of any Site User found to be in violation of its Terms.

For clarity, the Creative Commons Public Domain License does not apply to the Content on any external sites which WhozNews may link to.

Copyright violations and complaints

WhozNews takes claims of copyright and other intellectual property infringement extremely seriously. It is our policy to promptly process and investigate notices of alleged infringement.

WhozNews will take appropriate actions under the Digital Millennium Copyright Act (''DMCA'') and other applicable intellectual property laws. Upon receipt of notices complying or substantially complying with the DMCA, WhozNews reserves the right immediately remove or disable access to any Content, reference, link, submission, or activity claimed to be infringing or claimed to be the subject of infringing activity.

Infringers will have their accounts deleted, and will be restricted from further use of or access to Site features and services.

Notifying WhozNews of copyright infringement:

To notify WhozNews of an infringement, you must provide a written communication to the attention of ''DMCA Infringement Notification Dept'', care of (info @ whogets.com or Arcavate Corporation, 2101 Sardis Road N, Suite 207, Charlotte, NC 28227-6792) that sets forth the information specified by the DMCA (http://www.copyright.gov/title17/92chap5.html#512).

We reserve the right to submit your notification, with your personal information deleted, to a clearinghouse such as chillingeffects.org.

Please note that you may be liable for monetary or other damages (including court costs and attorneys' fees) if you materially misrepresent that an activity is infringing your copyright.

Providing WhozNews with counter notification:

If we remove or disable access to Content in response to an infringement notice, we will make reasonable attempts to contact the individual who posted such Content and/or the administrator of the affected site.

If you feel that your material does not constitute infringement, you may provide WhozNews with a counter notification. To do so, you must send a written communication to the attention of ''DMCA Counter Notification Dept'', at of (info @ whogets.com or Arcavate Corporation, 2101 Sardis Road N, Suite 207, Charlotte, NC 28227-6792) that sets forth all of the necessary information required by the DMCA (http://www.copyright.gov/title17/92chap5.html#512).

Please note that you may be liable for monetary and other damages (including costs and attorneys' fees) if you materially misrepresent that an activity is not infringing the copyrights of others. We strongly advise you to seek the advice of an of an attorney.

Rights and responsibilities of Authors

Permission to reprint Articles submitted by Site Users

By submitting an Article to WhozNews, you are thereby granted us unconditional permission to:

a. Publish your article on the WhozNews website

b. Reprint your article in or on other eZines, newsletters, websites, and/or print publications

c. Distribute your article via RSS fee and/or to email alerts and/or newsletters transmitted to WhozNews users.

Enforcement of reprint rules

WhozNews asks all publishers of User article(s) to follow our reprint rules. However, you agree that WhozNews is not, in any way, responsible for enforcing the reprint rules. WhozNews is not and cannot be responsible for violations of these rules on the part of publishers.

By agreeing to these Terms, and thereby granting us unconditional permission to reprint your article(s), you acknowledge that the enforcement of the reprint rules is solely your responsibility. Furthermore, pursuing legal action for the violation of your intellectual property rights is solely your responsibility. Except upon a valid and enforceable court order, WhozNews is not obligated to assist with or otherwise participate in such legal actions or proceedings.

Whether, how, and where Articles are published

Whether and for how long your Article is published is in the sole discretion of WhozNews. WhozNews does not guarantee that your Article will be published, and we reserve the right to remove any Article at any time for any reason or no reason at all.

Furthermore, WhozNews cannot and does not guarantee that a Publisher will select your Article for reprinting.

We reserve the right to move your Articles to the category we deem most appropriate.

You acknowledge and understand that WhozNews has established and posted a set of editorial guidelines which all Articles must meet. If your Article does not conform to one or more of our editorial guidelines, we may edit your Article so that it does conform to these guidelines.

However, WhozNews is under no obligation to edit articles for conformity with guidelines. We reserve the right to reject an Article on the basis of lack of conformity to editorial guidelines.

We ask that you carefully review the editorial guidelines before submitting any Article.

Payment

WhozNews does not pay for submissions to our Site. Furthermore, we do not require that a publisher pay you for use of and/or reprinting your article(s)

Reprint policy and rules

Permission to reprint

In most instances, WhozNews does not own the copyrights to the Articles posted on our Site. However, we do have permission for publishing them and for allowing others to reprint them in accordance with our Terms of Use.

No additional permission from an Article's Author is required for reprinting the Article as long as you abide by these Terms of Use.

Notifying Author

WhozNews strongly recommends that Publishers notify an Author that their Article is being reprinted. Obtaining the necessary contact information is the sole responsibility of the Publisher.

Failure to abide by Reprint policy and rules

Any individual who reprints any original Article posted to WhozNews agrees to abide by our reprint policy. You acknowledge and agree that your failure to abide by our reprint policy can result in the suspension or deletion of your account, and your future access to the site may be blocked.

Copyrights

WhozNews respects the copyrights of its members. As such, Publishers must:

  1. Reprint the article in its entirety and with no changes, including the article's title and content
  2. Include the FULL Resource box or SIG line at the end of the article
  3. Ensure that all links are active/linkable
  4. Include the following source credit/active link below the article:

Additionally, you may not create any derivative works from the articles posted on WhozNews, including but not limited to audio or video derivatives or translations into other languages.

Prohibited sites

WhozNews reserves the right to forbid Publishers from reprinting Articles on Sites which WhozNews deems offensive, violative of national or international law, or otherwise objectionable.

Publishers agree not to reprint any Article found on WhozNews to any website or webpage that contain illegal filesharing or P2P software or instructions for making bombs; advocates or promotes any illegal activity or hatred, racism, or bigotry; contains pornographic material; or exploits children, animals, or any human.

Objectionable sites are not limited to those described in the above paragraph. WhozNews reserves the right to add to or alter the paragraph above at any time in its sole discretion, with or without notice. It is the Publisher's responsibility to periodically review this list.

Additional reprint rules

In addition the rules outlined above, Publishers agree to abide by the following rules and guidelines listed below.

By publishing an Article posted on WhozNews, publishers agree not to:

  1. Reprint any Article on WhozNews by way of unsolicited email, spamming, or pop-up ads.
  2. Sell articles any Article on WhozNews or charge others to view a WhozNews Article you have reprinted
  3. Inclue the rel=nofollow tag in your HREF statements
  4. Add any active links to any Article you reprint from WhozNews
  5. Reprint, publish, or distribute any Author photo or images found on our site
  6. 6. Use article crawlers, rogue bots, site scrapers, or any automated script/software or method that attempts to mine the Article content on WhozNews.

Failure to abide by any of the above rules will result in the immediate termination of your account, and you will be permanently forbidden to reprint any Article found on WhozNews.

Limit on number of articles reprinted

Publishers may reprint no more than 25 articles from WhozNews per calendar year per unique domain owned by such Publisher.

Violations of Terms of Use and/or violations of Author copyrights

You acknowledge and agree that if you are found to be in violation of any of the above Terms of Use and/or any the copyrights of any WhozNews Author, you will be held liable for all attorney fees and statutory damages awarded upon a copyright infringement law suit that may be brought against you.

You agree that any legal proceedings against you will occur in Mecklenburg County in the State of North Carolina, USA.

Revocation of reprint rights

WhozNews reserves the right to revoke these reprint rights at any time for any or no reason. Should revocation occur, we will provide you with 48 hours notice via one or more of the following methods: email, fax, telephone, or postal mail.

Upon receipt of this notice, you have 24 hours to remove every article you received from WhozNews. After removal, you must provide us with a written reply stating that you have removed the material(s).

Your reprinting or use of any article posted on WhozNews is entirely at your own risk. WhozNews is not responsible for any damages occurring as a result of your use of this Site or any of its features, services, and/or Content.
